No Tulsa Sex Offender Halloween Ban... This Year

Don’t expect Tulsa to ban sex offenders from handing out Halloween candy this year. Councilor Jeannie Cue says she has heard from residents wanting such a ban.

JEANNIE CUE: "I have got some calls from constituents about ordinances they have in Louisiana, Missouri, Virginia, California and Maryland and we have nothing here."

City Prosecutor Robert Garner says that would be better addressed on the state level. He says any local ordinance would be challenged in court.

City Attorney David O’Mielia says other states have similar laws and even those have been challenged in court. The laws were declared unconstitutional because the ban was added after the defendant was convicted. You can't enhance a penalty, after the sentencing.
