Oklahoma City, OK – Report: Dead infant left with mother despite drugs

OKLAHOMA CITY (AP) A report by the agency that oversees the Oklahoma Department of Human Services says an infant who died three months after her birth was left in her mother's custody despite the mother testing positive for illegal drug use.

The Oklahoma Commission on Children and Youth report says both Crystal Erb and her daughter Tamberlynn Wheeler tested positive for marijuana when the child was born Dec. 31, 2007. The girl died three months later weighing five ounces less than she weighed at birth.

An autopsy failed to determine a cause of death.

Erb and the girl's father Samuel Wheeler Junior were charged this year with child neglect in the case.

DHS spokeswoman Sheree Powell told The Oklahoman that each case is considered individually.
