Man Declared Innocent in One Case, Back in Court on Another

An Oklahoma man declared innocent by a judge this week for a 1994 drive-by shooting must return to the same courthouse next month on an unrelated assault charge.

DeMarchoe Carpenter was exonerated Monday, along with Malcolm Scott, in the killing of 19-year-old Karen Summers after the men served 20 years in prison.

New evidence, including a videotaped confession of a death row inmate who took responsibility for the shooting, convinced Tulsa Judge Sharon Holmes to exonerate them.

Nearly two months before Holmes' ruling, Carpenter was accused of holding one inmate so another could beat the inmate with a metal object.

Carpenter's pleaded not guilty and is due in court on June 7 for a preliminary hearing. He posted $10,000 bond on Monday related in the assault charge.
