Latest Pruitt Lawsuit Against EPA Thrown Out

Oklahoma Attorney General Scott Pruitt’s second go in court at a proposed EPA rule has been dismissed.

A judge in Tulsa's U.S. District Court said her court doesn’t have jurisdiction. The suit challenged the EPA’s Clean Power Plan, which calls for a 30 percent reduction in emissions at coal-fired power plants and isn’t yet in effect. Pruitt spokesman Aaron Cooper said he may try again when it is.

"Another option would be to appeal to the 10th Circuit, so there's a couple different avenues and a couple different legal tools available to us," Cooper said. "We're examining what will be the best one."

Pruitt's first challenge to the Clean Power Plan was last year, when he joined a West Virginia lawsuit claiming the agency overstepped its authority.

Judges in both cases mentioned the rules weren’t even in effect.
