Tulsa, Ok – Appeals court reverses Okla. child porn conviction
TULSA, Okla. (AP) A federal appeals court has reversed the conviction of a Tulsa businessman who was accused of knowingly receiving child pornography.
A three-judge panel of the 10th U.S. Circuit Court of Appeals on Wednesday set aside the 2008 conviction of Terry Brian Dobbs.
Dobbs contended there was insufficient evidence to prove he knowingly received either of two pornographic images that were shown to his jury. He also argued there was insufficient evidence to prove the images traveled in interstate commerce as required for a conviction.
In a 2-1 decision the court concluded the government didn't offer enough evidence to prove Dobbs knowingly received the images.
A spokesman for the U.S. Attorney's Office in Tulsa did not immediately return a phone call seeking comment.
