Tulsa Attorney Opposes Breath Test Bill

  A Tulsa attorney specializing in drunken-driving cases is criticizing legislation that would criminalize refusing to take a breath test to determine if someone is intoxicated.

The Tulsa World reports attorney Bruce Edge announced his opposition Tuesday and discussed filing a lawsuit to challenge a new set of administrative rules dealing with DUI arrests.

Under the bill, refusing to take a breath test if requested by law enforcement would be a misdemeanor punishable by a fine of up to $1,000 and 10 days in jail. Edge says that means drivers wanting to first talk to an attorney could be criminally charged.

The bill from Republican Sen. Kim David was approved by a Senate committee. David says her staff is rewriting portions of the bill that have drawn concerns.
