The Oklahoma Supreme Court has rejected a constitutional challenge to a proposed 1 percent sales tax increase to help fund public education in Oklahoma but has rewritten the measure's ballot title, ruling that the original one was misleading.
An anti-tax group opposed to the measure challenged the proposal last month. OCPA Impact argued a brief description of the proposal that appeared on signature pages was insufficient and its proposed ballot title was misleading.
In a ruling handed down Monday, the state's highest court said the group's challenge of the tax plan's signature page description was untimely because the signatures had already been submitted and counted. But the Supreme Court agreed the ballot title was misleading and rewrote it.
The tax measure will appear on the Nov. 8 general election ballot.
