Muskogee, OK – Okla. judge refuses to remove prosecutor in mall shooting

MUSKOGEE, Okla. (AP) Muskogee County District Attorney Larry Moore will not be removed as prosecutor in the deadly Muskogee mall shooting case.

Special District Judge Robin Adair rejected the motion by the attorney for 25-year-old Tenesha Nunley to remove prosecutor Larry Moore. Defense attorney James Walters argued that Moore could be called as a witness because Nunley made incriminating statements to him before being read her rights.

Moore said his contact with Nunley was unsolicited and that he told her to talk to police not him.

Nunley is charged as an accessory in the April 10 mall shooting that killed a 17-year-old. Police say she picked up the suspects after the shooting and housed and fed them.
