Tulsa, OK – Judge: Prosecutors can use most Kastner statements
TULSA, Okla. (AP) A Tulsa County judge says that during the trial for a former teacher accused of fatally shooting his wife, prosecutors can use most of the statements the man allegedly made to police.
But as part of his ruling Thursday, District Judge Clancy Smith also said part of one recorded police interview with John Robert Kastner cannot be used during the trial. Smith says some of the comments in the interview came after Kastner had asked for an attorney.
Kastner, a 52-year-old former Webster High School teacher and coach, is accused of first-degree murder in the June 25, 2008, death of his wife, attorney Lori Moon Kastner. John Kastner has blamed an intruder for the killing.
First Assistant District Attorney Doug Drummond says the portion of the statement excluded by the judge was "redundant."
Kastner's trial is set to start Aug. 16.
