Grand Jury Indictments

Tulsa, OK –
Thomas Scott Woodward, United States Attorney for the Northern District of Oklahoma,
announces the results of the August 2010 Federal Grand Jury.
The following named individuals have been charged with a federal crime or crimes by the
return of an indictment by the Grand Jury. The return of an indictment is a method of
informing the defendant of alleged violations which must be proven in a court of law beyond
a reasonable doubt to overcome the defendant's presumption of innocence.

Andrew Hair. Aggravated Sexual Abuse by Force of Minor in Indian Country, Sexual
Abuse of a Minor in Indian Country. Hair, 51, a Cherokee tribal citizen from Pawnee,
Oklahoma, is accused of sexually abusing a 15 year-old non-Indian female on July 10, 2010.
The act allegedly occurred in Osage County on Osage tribal land.

Donald Paul Moen. Burglary in the First Degree in Indian County, Robbery in Indian
Country, Assault by Striking, Beating and Wounding in Indian Country. Moen, age 31,
a non-Indian from Pawhuska, is accused of breaking into the home of an elderly male Osage
tribal citizen in Pawhuska on July 15, 2010, and then beating and robbing him. The alleged
criminal act occurred on Osage tribal land.

Enoch Delbert McNight. Armed Robbery, Felon in Possession of Ammunition. The
defendant, 37, of Tulsa, is accused of the armed robbery of the Bank of the West, located at
6100 East 51st Street, Tulsa, on July 8, 2010. He is also charged with having five rounds of
9mm Luger ammunition in his possession on July 15, 2010. McNight has five previous
felony convictions from Tulsa County District Court from 1995-1996, which include three
counts of armed robbery, shooting with intent to kill and attempted escape from penal
institution.

Andres Bustamante-Medrano. Alien in the United States after Deportation. The
defendant, 30, a citizen of Mexico, was allegedly found in the Tulsa County Jail on June 21,
2010. He was previously deported and removed from the U.S. in November 1998.

Jose Anuar Claudio-Ortiz. Alien in the United States after Deportation. The defendant,
33, a citizen of Mexico, was allegedly found in the Tulsa County Jail on March 27, 2010.
He was previously deported and removed from the U.S. in January 2006.

Ruben Flores-Olmos. Alien in the United States after Deportation. The defendant, 23,
a citizen of Mexico, was allegedly found in Nowata on July 7, 2010. He was previously
deported and removed from the U.S. in May 2007.

Franciso Diaz-Vallendrano. Alien in the United States after Deportation. The defendant,
approximate age 35, a citizen of Mexico, was allegedly found in the Tulsa County Jail on
June 27, 2010. He was previously deported and removed from the U.S. in April 2009.

Samuel Charles Smith. Felon in Possession of Firearm and Ammunition, Possession
with Intent to Distribute Cocaine Base, Possession with Intent to Distribute Cocaine,
Possession with Intent to Distribute Marijuana, Possession of a Firearm in Furtherance
of Drug Trafficking Crime. Smith, 33, of Tulsa, was allegedly found in possession of
quantities of crack cocaine, powder cocaine, marijuana and a loaded .40 caliber pistol at the
time of his arrest in Tulsa on June 24, 2010. He has two previous felony drug trafficking
convictions (2002 and 2009) from Tulsa County District Court.
